Delhi High Court Stays Bail Order for CM Arvind Kejriwal in Excise Policy Case

The Delhi High Court on Friday stayed the trial court’s decision to grant bail to Chief Minister Arvind Kejriwal in the excise policy case. The stay will remain until the court pronounces its order on the Enforcement Directorate’s (ED) plea seeking to overturn the bail order. Justice Sudhir Kumar Jain’s vacation bench announced it would take two to three days to decide on the ED’s application, allowing both parties to submit written arguments by Monday.

The high court also issued notices regarding the ED’s application for a stay and its plea challenging the trial court’s decision to grant bail to the Aam Aadmi Party (AAP) convenor. Kejriwal was granted bail by a city court on Thursday, which the ED has vehemently opposed. During the hearing, ED’s counsel SV Raju criticized the trial court’s decision as “lopsided” and “one-sided,” arguing that the court did not properly consider the documents before ruling them irrelevant.

The case stems from allegations against Kejriwal concerning irregularities in Delhi’s excise policy. The ED’s additional solicitor general argued that the trial court’s failure to review pertinent documents before making its decision was “perverse.” The high court’s stay order places Kejriwal’s bail on hold until the pending pronouncement, maintaining the legal tension surrounding the case.
