Delhi High Court Seeks Police Response in Journalist Saumya Vishwanathan Murder Conviction Appeal

In a significant development, the Delhi High Court has called for a response from the police in response to pleas challenging the life sentence and conviction of four individuals accused of murdering journalist Saumya Vishwanathan in 2008. The Justice Suresh Kumar Kait-led bench issued the notice and has also requested the trial court records. Vishwanathan, employed at Headlines Today (now India Today), was fatally shot in her car in South Delhi during a robbery attempt on September 30, 2008. The trial court, on October 18, had found Baljeet Malik, Ravi Kapoor, Amit Shukla, and Ajay Kumar guilty of murder under the Indian Penal Code and the Maharashtra Control of Organized Crime Act.

The trial court’s decision, which convicted the four men on charges of murder and common intention, has been met with appeals. Notably, the court sentenced the convicts to two consecutive life imprisonments in November, refraining from imposing the death penalty, citing that the act did not fall under the category of the “rarest of rare.” Baljeet Malik, one of the convicts, has argued in his appeal that the conviction cannot be sustained, pointing out that the first information report was initially filed as a blind murder case with no arrests until March 2009. Malik alleges that the Delhi Police succumbed to media pressure, falsely implicating them after their arrest in the 2009 murder case of BPO employee Jigisha Ghosh.

The defense maintains that the prosecution has failed to establish a link between the accused and the alleged offense, emphasizing the absence of evidence such as the recovery of weapons or vehicles from the accused. With the matter set for hearing on February 12, the Delhi High Court’s intervention underscores the ongoing legal battle surrounding Saumya Vishwanathan’s tragic murder and the subsequent convictions.
