Pakistan’s Supreme Court Alters Disqualification Rule for Lawmakers

In a significant turn of events, Pakistan’s Supreme Court has overturned the prior lifetime disqualification for lawmakers, opting instead to limit their exclusion from office to a five-year term. This groundbreaking ruling brings relief to prominent political figures, including former Prime Ministers Nawaz Sharif and Imran Khan. The decision, made by a seven-member bench led by Chief Justice Qazi Faez Isa, challenges a 2018 judgment that had enforced lifetime disqualification under Article 62(1)(f).

The alteration in disqualification terms stemmed from changes enacted in the Elections Act 2017 on June 26, 2023, under the governance of a coalition government spearheaded by the Pakistan Muslim League-Nawaz (PML-N). This amendment restricted the disqualification to a finite five-year period, diverging from the prior stance that mandated a permanent ban. The recent ruling, carrying a 6 to 1 split judgment, directly opposed the earlier decision supporting lifelong disqualification.

Notably, Justice Yahya Afridi deviated from the majority opinion, expressing dissent by favoring the continuation of lifelong disqualification. This verdict has conclusively settled the contentious debate surrounding the duration of disqualification under Article 62(1)(f) of the Constitution and the Elections Act 2017. The implications are far-reaching, particularly for figures like Nawaz Sharif, a former Prime Minister and a leading contender for a fourth term in the upcoming February 8 general elections, who faced disqualification in the Panama Papers case in 2017. Imran Khan, Sharif’s rival, who encountered disqualification in the Toshakhana corruption case last year, also falls within the purview of this altered law.

This ruling not only impacts the political landscape but also sets a definitive precedent, reshaping the criteria for lawmakers’ eligibility, and potentially influencing the upcoming elections and the country’s political trajectory.
