Supreme Court to Consider Urgent Hearing on NCP Symbol Dispute
In a significant political development, Nationalist Congress Party (NCP) founder Sharad Pawar has approached the Supreme Court seeking an urgent hearing on his petition against the Election Commission of India’s (ECI) decision, which favored the Ajit Pawar-led faction with the party’s name and symbol. Chief Justice of India Dhananjaya Y. Chandrachud assured to look into the matter for a possible hearing on Monday, after the plea was stressed for urgency by senior counsel Abhishek Manu Singhvi. This appeal comes in the wake of the Maharashtra assembly speaker’s ruling, which identified the deputy chief minister Ajit Pawar’s faction as the genuine NCP, igniting a fierce intra-party battle.
The controversy took a new turn when the ECI granted the Ajit Pawar faction the right to use the NCP name and its clock symbol, based on the “Test of Majority”. This ruling has put Sharad Pawar in a challenging position, especially with the upcoming session in the Maharashtra assembly. The senior Pawar’s faction, now required to adopt the name Nationalist Congress Party-Sharadchandra Pawar for the Rajya Sabha election, has raised questions about the ECI’s decision-making process.
The ECI’s verdict was influenced by affidavits from party lawmakers, showing a clear majority in support of Ajit Pawar. Out of the total party members in parliament and the assembly, a significant number sided with Ajit Pawar, leading to the ECI’s decision. However, Sharad Pawar’s faction contested this outcome, citing the party’s constitution and organizational structure to claim legitimacy. This political drama underscores a pivotal moment for the NCP, as the Supreme Court’s decision could redefine the party’s future direction.
