‘Cost of educating the children is the responsibility of divorced couple equally’ : Bombay High Court

The Nagpur bench of the Bombay High Court has held that divorced parents are equally responsible for the education of their children. The High Court said this in a complaint filed by a student alleging that Dhanbad was facing financial difficulties to join IITs. The court rejected the father’s claim that he could not find money for his son’s education.

He told the court that he had to look after the elderly mother, the sister who was separated from her husband and their daughter and therefore could not bear the cost of her son’s education. But the court made it clear that as a father, the son’s case should be looked at first. The 18-year-old’s parents divorced years ago. Both teachers receive a monthly salary of Rs 48,000. Therefore, the division bench said that the education expenses of the son should be borne equally by both.

The court also ordered the father to increase his monthly allowance from Rs 5,000 to Rs 7,500 from October 27, 2015. In 2015, the student approached the court with a complaint. He passed Class X with 93 percent marks. He then approached the court stating that he did not have the money to join IIT for his studies.

The mother paid for the education. The father paid Rs 5,000 per month following the court order. However, the son approached the court seeking Rs 15,000 per month from his father. The couple divorced in 2009 by mutual consent. The son was later raised by his mother.
