Delhi High Court Declines PIL Against Chief Minister Arvind Kejriwal

In a significant ruling on Thursday, the Delhi High Court dismissed a Public Interest Litigation (PIL) that sought the removal of Arvind Kejriwal from his position as the Chief Minister of Delhi. The plea came in the wake of Kejriwal’s arrest by the Enforcement Directorate in connection with a money laundering case that is tied to the controversial and now-defunct Delhi excise policy.

The bench, led by Acting Chief Justice Manmohan and comprising Justice Manmeet PS Arora, refrained from delving into the merits of the case. Instead, it emphasized that the issue falls beyond the purview of judicial intervention. The court highlighted that it is the prerogative of other governmental branches to address such matters by the law.

During the proceedings, the court questioned the petitioner, Surjit Singh Yadav’s counsel, about the legal grounds that would prevent Arvind Kejriwal from continuing as the Chief Minister. Despite the challenges highlighted, the court sought clarity on the legal prohibitions against Kejriwal’s incumbency. The Aam Aadmi Party leader, who was arrested on March 21 and is in the Enforcement Directorate’s custody till March 28, is accused of favoring specific individuals in the formulation of the excise policy.
